JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioners and the State. The petitioner no.1 being the husband of the victim and petitioner nos. 2 and 3 being the parents of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under Section 304B of the Indian Penal Code. The accusation is of killing the daughter of the informant within two years of the marriage for non-fulfilment of the dowry demand.
It is submitted by learned counsel for the petitioner that the victim died due to illness at her parents' house and the informant has subsequently retracted from his initial version and filed a petition that effect before the learned court below. Considering the above fact, this Court is not inclined to
Patna High Court Cr.Misc. No.13867 of 2015 (2) dt.08-05-2015 2/2 grant bail to petitioner no.1.
Accordingly, application with regard to petitioner no.1 is rejected.
So far as petitioner nos. 2 and 3 are concerned, since the accusation is omnibus and general against them, let the above named petitioner nos. 2 and 3 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Muzaffarpur in connection with Maniyari P.S. Case No. 254 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
