The petitioner seeks bail in connection with Rafiganj P.S. Case No.10 of 2014 registered under Section 392 and, subsequently, added Sections 395 and 412 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in this case in the confessional statement of the co-accused Sujit Kumar and Pukar Mehta alias Pukar Mahato, as detailed in paragraphs-72 and 79 of the case diary. Except that, there is nothing against the
Patna High Court Cr.Misc. No.27903 of 2017 (2) dt.23-06-2017 2/2 petitioner to show his involvement in the commission of the alleged offence. The petitioner is in custody since 03.02.2017 but he has not been put on T.I. Parade. Further submission is that as the petitioner is accused in seven other cases, due to that reason, the police got managed to implicate the petitioner in the present case.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-V, Aurangabad, in connection with Sessions Trial No.16 of 2015, arising out of Rafiganj P.S. Case No.10 of 2014.
