The petitioner apprehends his arrest in connection with Phulwarisharif P.S. Case no. 729 of 2018, registered under Section 452, 323 and 354 of the Indian Penal Code. The accusation is that on 15/16-09-2018, the informant along with his wife were sleeping in the room. In the meantime, wife of the informant woke up and went to take water then saw the petitioner inside the room. Thereafter, informant and his wife tried to catch the petitioner, but he succeeded to flee away.
Learned counsel for the petitioner submits that petitioner and informant are co-villagers. Further submission is that, in fact, Komal Devi, sister-in-law of the petitioner lodged
Patna High Court CR. MISC. No.14814 of 2019(4) dt.19-06-2019 2/2 Phulwarisharif P.S. Case No. 487 of 2017, under Sections 341, 323, 354, 379, 504 and 506/34 of the Indian Penal Code and Section 3(1)(x) of SC/ST Act on 08.08.2017 against the informant of the present case due to that reason only to put undue pressure, the informant lodged the present case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-X, Patna in connection with Phulwarisharif P.S. Case No. 729 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
