JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 448, 427, 379, 504 and 506 of the Indian Penal Code. It is alleged that the co-accused Mainuddin and Guddu entered into the house of the informant and tried to stab him but no injury was caused. Thereafter, all the accused persons assaulted the informant by 'lathi' and 'danda' when uncle and mother of the informant came to rescue they were also assaulted. It is further alleged that the petitioner took away a box containing ornaments worth Rs.30,000/- and cash of Rs.50,000/-.
It is submitted by learned counsel for the petitioner that specific accusation of assault is not against the petitioner and injury of the informant and his uncle is found simple in nature.
Patna High Court Cr.Misc. No.15078 of 2015 (2) dt.13-05-2015 2/2 The accused against whom the specific accusation is Guddu, who has been granted anticipatory bail vide Criminal Miscellaneous No. 28564 of 2014. There is counter version of the occurrence alsp and the petitioner's side also received injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No.165 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
