JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner disputes the factum of marriage. The impugned order dated 23.01.2016 reflects that in spite of several opportunities being given the petitioner chose not to appear.

In the circumstance, the application is disposed of with liberty to the petitioner to move before learned Sessions Judge afresh in connection with Bidupur P.S. Case No. 203 of 2015, Complaint Case No. 1340 of 2015, pending in

Patna High Court Cr.Misc. No.11391 of 2016 (2) dt.09-03-2016 2/2 the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
