Petitioner seeks bail in a case registered for the offences punishable under Sections 20,22,23 and 24 of the N.D.P.S. Act whereas charges have been framed only under Section 20(b)ii(c) of N.D.P.S.Act.

The petitioner is in custody since 08.01.2014. Allegation is that 03 Kg of Charas was recovered from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

The report of the learned Trial Judge would reveal that the trial is at the stage of prosecution evidence. Considering the entire facts aforesaid especially the period already undergone by the petitioner, let the

No.11062 of 2018 (3) dt.12-04-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No.05 of 2014 arising out of Raxaul P.S.Case No.16 of 2014, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below having immovable property and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
