JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Khagaria P.S. Case No. 180 of 2016 registered under Sections 387 and 506/34 of the Indian Penal Code.

One Ravi Mahto is said to have demanded extortion money of Rs. 1 lac from the informant through the petitioner and the petitioner was apprehended by the villagers and handed over to the police and said Ravi Mahto again demanded aforesaid extortion money from the informant by mobile phone. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case due to dirty village

Patna High Court Cr.Misc. No.13026 of 2018 (3) dt.04-04-2018 2/2 politics and animosity. He never went to the informant to demand any extortion money from him. He has no concern with Ravi Mahto. Though two more criminal cases have been lodged against the petitioner, but he has been enlarged on bail in the aforesaid cases. The petitioner has been languishing in custody since 16.12.2017. Said Ravi Mahto has been enlarged on bail by a coordinate bench of this court in Cr. Misc. No. 20625 of 2016 vide order dated 19.05.2016.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 180 of 2016.
