JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The case has been listed today under the heading "to be mentioned" at the instance of the learned counsel for the petitioner.

Submission of the learned counsel for the petitioner is that at Para 3 of order dated 17.07.2017 passed in Cr. Misc. No.28222 of 2017, name of „Rajesh Yadav' has been mentioned, however, „Rajesh Yadav' is the petitioner in the present case, as such his name may be deleted and secondly, it has been submitted that it is the case for regular bail but in Para 5 of the order, it has wrongly been mentioned due to typographical error that „let petitioner surrender before the court of learned Chief Judicial Magistrate - VIIIth, Siwan within a period of four weeks and on his so surrendering the court below will release him on furnishing bail

Patna High Court Cr.Misc. No.28222 of 2017 (4) dt.25-07-2017 2/2 bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate- VIIIth, Siwan, in connection with Raghunathpur P.S.Case No.27 of 2017' but from perusal of the order, it appears that the case is for grant of regular bail as such in place of the aforesaid words be read as "let the petitioner be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below" and conditions as mentioned in order dated 17.07.2017 passed in Cr. Misc. No.28222 of 2017 shall remain same.

So far mentioning the word „Rajesh Yadav' at para 3 of the order, due to typographical error, is concerned, let it be deleted. The order dated 17.07.2017 passed in Cr. Misc. No.28222 of 2017 is modified to the extent as aforesaid. Let the aforesaid order be communicated to the court below concerned.
