Patna High Court CWJC No.4317 of 2024(2) dt.22-03-2024 2/3 and others) which order passed in pursuance of order of Hon'ble Court dt 02.08.2023 passed in CWJC No.

17787/2014, whereby and whereunder learned Court below set aside the appointment an Aganbari Sevika to the petitioner and order to D.P.O. (I.C.D.S) Gopalganj to complete selection process in favour of Smt Mala Devi on that Aganbari Centre, without examining the real fact regarding petitioner who is working from year 2005 as Aganbari Sevika till today and also issuance of a writ in the nature of Mandamus directing and commanding the respondent authorities to not disturbe the petitioner as working as Anganbari Sevika at centre i.e. Centre no. 38, Alapur Centre and Or pass appropriate order / orders as deem fit and proper."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including

Patna High Court CWJC No.4317 of 2024(2) dt.22-03-2024 3/3 that of filing a suit before the Ld. Civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
