JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/34 and other ancillary sections of the Indian Penal Code.

Prosecution case is that all the FIR named accused persons including the petitioner and 20 to 25 unknown persons set ablaze the house of the informant and assaulted her with fists and lathi and rod causing her head injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case in which both sides sustained injuries. There is land dispute and injury caused by the petitioner was found to be simple in nature. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Kochadhaman Police Station Case No. 226 of 2021/GR No. 1351 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
