JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(a)/47 of the Bihar Prohibition and Excise Act, 2016.

Foreign liquor was allegedly recovered from the vehicle on which the petitioner was traveling. Submission is that petitioner has got no criminal antecedent and he is in custody since 26.03.2017. Moreover, coaccused Bittu Kumar Pradhan has already been allowed bail by a coordinate Bench of this Court.

Considering the aforesaid submission, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.29173 of 2017 (2) dt.05-07-2017 2/2 bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/Successor Court, in connection with Brahmpur (Krishna Brahm) P.S. Case No.93 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
