Petitioners apprehend their arrest in Hajipur Sadar P.S. Case No.539 of 2018, registered under Sections 307, 353, 333, 332, 427 and other minor sections of the Indian Penal Code as well as under Section 27 of the Arms Act.
The informant, a police officer, disclosed that during the night patrolling, he got information that a consignment of liquor was to pass through the road near Dighi Lal Pokhar. The informant and other police officials went there. In the meantime, a motorcyclist fled away from there. When the informant followed the motorcyclist, the villagers surrounded the informant and other police officials and started pelting stones. The accused persons also made firing. Patna High Court CR. MISC. No.14420 of 2019(2) dt.08-03-2019 2/2 Chowkidar disclosed that Jagarnath Rai and his sons are indulged in illicit trade of liquor and they have done this occurrence. Learned counsel for the petitioners submits that the petitioners are not the family members of Jagarnath Rai and his sons. Nobody has seen the petitioners participating in the occurrence. Petitioners have got no criminal antecedent.
Taking into consideration the facts that the local Chowkidar disclosed the fact that Jagarnath Rai and his sons involved in illicit trade of liquor and it was they who committed the crime but the Chowkidar did not disclose the name of the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge,2nd-cum-Special Judge, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.539 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
