The petitioner seeks bail in Buddha Colony P.S. Case No. 87 of 2017 registered under Section 380, 411 and 454 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have tried to commit theft in the flat of the niece of the informant by breaking the bolt of the door and was apprehended with some silver ornaments and the instrument meant for breaking the bolt. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case by the informant due to dispute over the payment for painting the flat of

It is further submitted by the learned counsel for the petitioner that one criminal case under sections 454 and 380 of the Indian Penal Code is pending against the petitioner and he is on bail in that case. The petitioner has been languishing in custody since 17.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Buddha Colony P.S. Case No. 87 of 2017.
