JUSTICE ARUN KUMAR ORAL ORDER 02-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 14.12.2017, seeks bail in connection with Ahiyapur P.S.Case No. 1068 of 2017 registered under Sections 399 and 402 of the Indian penal Code, Section 25(1-b)a, 26(ii)/35 of the Arms Act and 8/20(b)(ii)(B) of the N.D.P.S.Act.

Allegation in brief is that police recovered one country made pistol and five live cartridges from possession of the petitioner along with other arms from other accused persons and also 10 Kg. Ganja from the possession of Kishlay Singh. Submission is that petitioner is in custody since 14.12.2017 and has falsely been implicated in this case. However, petitioner has a number of criminal antecedents including arms act and dacoity, so presently the prayer of bail of

Patna High Court Cr.Misc. No.17935 of 2018 (2) dt.02-04-2018 2/2 the petitioner is rejected. The petitioner may renew his prayer of bail after six months.
