The petitioners seek regular bail in connection with Sadar P.S. Case No. 410 of 2021 registered for the offence under Sections 392 of the Indian Penal Code.

Allegation against the petitioners is that they along with other co-accused persons entered into the house of informant and looted gold, cash and mobile phones. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case on the basis of mere suspicion. Petitioners not named in the FIR and during course of

Patna High Court CR. MISC. No.15111 of 2022(3) dt.02-01-2023 2/2 investigation, the name of petitioners came into light. It is further submitted vide para 10 of the petition that petitioners have been arrested in Sadar P.S. Case No. 440 of 2021 thereafter they have been remanded in this case. It is further submitted that there is no TIP held against the petitioners. Petitioners are languishing in judicial custody since 21.09.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sadar P.S. Case No. 410 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Class Judicial Magistrate, Purnea.
