JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 379 of the Indian Penal Code.

It is alleged that two idols of alloy were stolen. In Rasulpur P.S. Case No. 136 of 2012 the stolen article was recovered from the possession of Tarkeshwar Soni who named the petitioner.

It is submitted by learned counsel for the petitioner that in Rasulpur P.S. Case No. 136 of 2012 the petitioner has been granted bail and admittedly the recovery has not been made from the petitioner.

Patna High Court Cr.Misc. No.13394 of 2015 (2) dt.01-04-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Dhaka P.S. Case No. 178 of 2012 pending in the court of learned C.J.M., East Champaran, Motihari.

This application is disposed of with the aforesaid observation/direction.
