Petitioner seeks bail in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The wife of this petitioner died in unnatural circumstances within few years of her marriage in her matrimonial house. There is allegation of demand of dowry and torture for the same before death. The allegation has been supported by other maternal family members of the deceased. Considering the nature of allegation and presumption of law, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 273 of 2018 arising out of Harnaut Police Station Case No. 380 of 2017 pending in the court of learned Chief Judicial Magistrate, Nalanda at Bihar
Patna High Court CR. MISC. No. 12016 of 2019(3) dt.07-05-2019 2/2 Sharif.
Hence, prayer for bail is refused.
Learned trial court is directed to expedite the trial and conclude the same preferably within a period of nine months from the date of receipt/production of a copy of this order. (Birendra Kumar, J) Kundan/- U T
