The petitioners being the parents, brother and covillager of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302, 201, 498A, 120B/34 of the of the Indian Penal Code. The accusation is of killing the daughter of the informant within 3 years of marriage for non-fulfillment of dowry demand and the dead body was recovered from a well. It is submitted by learned counsel for the petitioners that the petitioners reside separate from husband of the victim. In fact, the victim was a disabled lady and she might have fallen in the well due to disability. Moreover, the informant has retracted
Patna High Court Cr.Misc. No.14010 of 2015 (2) dt.08-05-2015 2/2 from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition. There is no eye witness of the occurrence.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jehanabad in connection with Parasi P.S. Case No.03 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
