Petitioner seeks regular bail in connection with Dehri Town P.S. Case No.98 of 2017, G.R. No.172/2017, registered for the alleged offences under Section 30 (a)/38 91)/41 (I) & (II) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 20 liters of country made liquor has been recovered from a boat on the bank of Sone river. The petitioner and three other accused persons who were indulged in vending the liquor managed to escape.
It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no
Patna High Court Cr.Misc. No.29101 of 2017 (02) dt.03-07-2017 2/2 offence. He has been falsely implicated in this case. There is no recovery from the conscious physical possession of the petitioner. He has no concern with the boat from which the liquor is said to have been recovered. The allegations levelled against the petitioner are general and omnibus in nature. He has been languishing in jail custody since 28.04.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas, Sasaram in connection with Dehri Town P.S.
