JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner seeks bail in connection with Jhajha P.S. Case No. 289 of 2019, dated 26.09.2019, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016 and Section 25 (1-a) of Arms Act. The petitioner is in custody since 27.09.2019. It appears that the house of the petitioner was raided and because of certain incriminating articles found in the house, two cases were registered. The first of the cases which was registered was Jhajha P.S. Case No. 290 of 2019 under Sections 419, 420, 467, 468, 471, 120 (b) of Indian Penal Code and Drugs and Cosmetics Act, 1940.

In the present case, there is recovery of certain cartons of beer bottles and a pistol, which is not in a working condition.

Regard being had to the nature of accusation against the petitioner, period of custody and the fact that apart from the two cases referred to above, there is no other case against the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Jamui in connection with Jhajha P.S. Case No. 289 of 2019 (State Versus Raushan Kumar), (G.R. No.- 2784 of 2019). The application stands allowed.
