JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioner seeks regular bail in connection with Jadia P.S. Case No. 43 of 2017, registered for offences punishable under Sections 25(1-B)a/26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of one country made pistol and cartridges.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner. As a matter of fact, although, the petitioner has been made accused in four other cases, but he is on bail in all the cases. Further, he has been rotting in judicial custody for the last four and half months. Learned A.P.P. opposed the prayer for bail on the ground that not only recovery is there but the petitioner is having criminal antecedents also, therefore, petitioner does not deserve
Patna High Court Cr.Misc. No.35694 of 2017 (2) dt.08-08-2017 2/2 the privilege of bail.
Having heard both sides, considering the fact and circumstances of the case, I am not inclined to release the petitioner on bail at this stage and therefore his application for regular bail is, accordingly, rejected.
However, the petitioner may renew is prayer for bail after framing of charge.
