The petitioner apprehends his arrest in connection with Katoria P.S. Case No.206 of 2016, registered for the offences punishable under Sections 341, 323, 324, 308, 337, 504 and 34 of the Indian Penal Code.

The petitioner is said to have assaulted the informant by means of iron rod on his head causing bleeding injury. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is submitted that the petitioner had been given benefit of Section 41(1) Cr.P.C., but later on, the police has

Patna High Court CR. MISC. No.13599 of 2022(2) dt.04-08-2022 2/2 submitted charge sheet against the petitioner, therefore, the petitioner has filed this anticipatory bail application. It is also submitted that there is land dispute between the parties and the injuries are simple in nature.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that the injuries are simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Banka in connection with Katoria P.S. Case No.206 of 2016, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
