Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 447, 302 and 504 of the Indian Penal Code. According to the FIR, petitioner and others assaulted with lathi to the father of the informant as well as to the informant. Father of the informant died as a result of assault. Submission is that the postmortem report would reveal that the Doctor has not found any external injury, save and except, three bruises on the left arm, left forearm and on the back. The opinion regarding cause of death is awaited till report of the forensic examination.

No.12018 of 2019(4) dt.07-05-2019 2/2 Considering the fact that allegation is not corroborated by medical evidence and investigation of the case is already complete against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Majhauliya Police Station Case No. 256 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
