JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
The prosecution case is that the daughter of the informant namely Preety Kumari aged 17 years when went to ease, she was being abducted.
It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement it is alleged that Md. Akram forcefully made the victim sit in the vehicle who was accompanied with the petitioner, Faiyaz and Iftekha. It is further submitted that in the same statement under section 164 Cr.P.C. the victim has
Patna High Court Cr.Misc. No.8863 of 2016 (2) dt.25-02-2016 2/2 stated that on the alleged date of occurrence Akram took her forcefully and she was caught by the police at Panipat in the company of Akram and only Akram accompanied the victim in the vehicle. The victim got her age recorded as 16 years whereas the court assessed her age as 17 years though the medical board assessed her age between 16 to 18 years. Statement has been made in paragraph 3 of the petition that the petitioners has no criminal antecedent.
Considering the fact that even as per statement made in the 164 Cr.P.C. the accusation is against co accused Akram, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No.210 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
