JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks regular bail in connection with Dehri (T) PS case no. 112 of 2017 registered for the offences punishable under Sections 272, 273, 420, 414 of Indian Penal Code and Sections 30(a)/ 38(i)/41(i)(ii) of Bihar Prohibition and Excise Act, 2016.

The case of the prosecution in short is that police had conducted raid at the place of occurrence and had caught the petitioner while he was trying to flee away. It is further alleged that the police had recovered illicit liquor from one motorcycle standing nearby.

Patna High Court Cr.Misc. No.29272 of 2017 (2) dt.01-07-2017 2/2 Learned counsel for the petitioner submits that no recovery has been made either from the possession of the petitioner or his house and petitioner is in custody since 19.02.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-II-cum-Special Court, Excise, Rohtas at Sasaram, Patna in connection with Dehri (T) PS case no. 112 of 2017.
