JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 04-05-2016 After having heard learned counsel for the petitioners, counsel for the State, there does not seem to be much of dispute now subsisting on the issue of grant of benefit of matric-trainedscale to the Assistant Teachers after certain judgments came to be rendered by two different Division Benches and subsequent orders also passed with regard to the status of such candidates, who passed the training examination and the compartmental examination. The benefit is supposed to accrue to such candidates, who have passed the training examination in the first attempt on 01.10.2003 and from the date of holding of the examination in the year 2007 with regard to those persons, who have passed the examination in the second attempt.
All these petitioners claim that they have passed the examination either in the first attempt or the compartmental examination of the first attempt. Therefore, according to them they will be entitled to benefit of matric-trained-scale from 01.10.2003. This position should be verified by the competent authority, who is said to be the District Education Officer, West Champaran, who will pass the necessary orders in this regard within a period of three months from the date of communication /
