JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-08-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Ram Bilas Roy Raman, learned APP for the State.

The petitioner in the present case is seeking regular bail in connection with Laxmipur P.S. Case No. 377 of 2020 registered for the offences punishable under Sections 25(1-B)a, 26(I) of the Arms Act. He is in custody since 10.10.2020.

Learned counsel for the petitioner submits that allegedly from possession of the petitioner there is recovery of one countrymade katta and three live cartridges. It is submitted that the petitioner has got no criminal antecedent and in the present case there is no independent witness to the seizure list.

Learned APP for the State has though opposed the prayer for regular bail of the petitioner but considering that the petitioner

No.22641 of 2021(2) dt.17-08-2021 2/2 has remained in jail in connection with this case for about 10 months, he has no criminal antecedent and there is no submission on behalf of the State that the release of the petitioner is likely to result in interfering with the course of justice, seizure list witnesses are the members of the police party, this Court directs release of the petitioner above named on bail on furnishing of bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class, Jamui in connection with Laxmipur P.S. Case No. 377 of 2020.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.

The application stands allowed.
