Petitioner seeks bail in a case registered for the offences punishable under Sections 413/414/34/411 of the Indian Penal Code and Sections 18, 22 and 27 of NDPS Act.
It appears that small packet of smacks was recovered from possession of some other co-accused. One of the arrested accused disclosed that he had purchased the stolen mobile from others. Petitioner had helped him to sell stolen mobile.
Since the petitioner is nowhere alleged to be involved with recovered contraband and co-accused Prem Pandey @ Kanhaiya has already been allowed bail by a
Patna High Court Cr.Misc. No.9696 of 2018 (2) dt.19-02-2018 Coordinate Bench of this Court in Cr.Misc.No. 4341 of 2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.158 of 2017 arising out of Kotwali Police Station Case No.555 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
