JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Belsand P.S. Case No. 100 of 2017 registered for the offences punishable under Sections 420, 467, 468, 371, 472, 409, 473, 474, 475, 477A of the Indian Penal Code and Section 17 of the Banking Act.
Allegation as per complaint petition, which was later on registered as FIR, is that the petitioner, who is an employee of the Consumer Service Centre, has received money from the customers but did not deposit in the Bank.
Submission of learned counsel for the petitioner is that other co-accused persons have been granted the privilege of anticipatory bail by co-ordinate Bench of this Court vide order dated 27.2.2018 passed in Cr.Misc.No. 11760 of 2018 and vide order dated 17.2.2018 passed in Cr.Misc.No. 2037 of 2018.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Sitamarhi, in connection with Belsand P.S.Case No. 100 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
