The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of commission of assault with iron rod over the forehead of Mihir Kumar. It is submitted on behalf of petitioner that as a matter of fact, while Mihir Kumar was crossing road, he was dashed by a motorcycle rider and Mihir Kumar started quarreling with him and petitioner pacified the matter between them, but mother of Mihir Kumar raised hulla that petitioner left the motorcycle rider, as a result of which, father of Mihir Kumar lodged this false and concocted case. During investigation, police did not find the case true and submitted final form against this petitioner. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.15740 of 2023(3) dt.26-06-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jhajha P.S. Case No. 99 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
