JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307,341,323 and 504/34 of the Indian Penal Code and section 27 of the Arms Act. It is specifically alleged that initially Nandu Choudhary and Kishun Kumar took the key of the informant's motorcycle and subsequently firing was made by Nandu Choudhary causing injury on the neck of the informant, thereafter it is alleged that this petitioner and Kishun also resorted to firing. It is submitted by the learned counsel for the petitioner that as per FIR itself the firing resorted to by petitioner and Kishun did not hit the informant. This fact gets further corroborated from the injury report which suggests simple fire arm injury which is

Patna High Court Cr.Misc. No.10206 of 2015 (2) dt.28-04-2015 2/2 attributable to Nandu Choudhary. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Kasim Bazar P.S. Case No. 228 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
