JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seek bail in connection with Bodh Gaya (Cherki) P.S. Case No. 441 of 2016 registered under Sections 448, 341, 323, 307, 376, 511 and 380/34 of the IPC. The accusation is that at 6 P.M. informant was at her house along with her two children and brother and about 8-10 persons entered into her house and they closing her mouth took her in a room, they protested them then Mozzam Khan assaulted her brother by butt of pistol causing him head injury and they also assault the informant by iron rod due to which she became senseless, and when her family members came in the house then she received consciousness. Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in this case. Petitioner is also made accused in two cases in which he is on bail. Petitioner is in custody since 06.04.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Bodh-Gaya (Cherki) P.S. Case No. 441 of 2016.
