Petitioner, already in custody, seeks bail in connection with Bhangaha P.S. Case No. 10 of 2018, registered under Sections 20, 22, 23, 24 and 27 of the NDPS Act. Allegation in brief is that 11⁄2 Kgs. of Ganja was recovered from possession of the petitioner.

Learned counsel for the petitioner submits that recovery is falsely shown, even on the seizure list, there is no acknowledgment of receipt of the petitioner.

Having considered the aforesaid facts and circumstances and the small quantity of the alleged recovery of Ganja, petitioner Daya Shankar Diswa @ Daya Shankar Diswah is directed to be released on bail after framing of the charge on
