JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Barharia P.S. Case No. 151 of 2016 registered under Section 304B and 34 of the Indian Penal Code.

As per the prosecution case, being peeved with the torture by the accused persons including the petitioner for demand of Scorpio, the daughter of the informant committed suicide. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus. The petitioner happens to be father-in-law of the

Patna High Court Cr.Misc. No.27894 of 2017 (2) dt.22-06-2017 2/2 deceased and he is aged about 70 years. He is living separately from the husband of the deceased and he has no concern with the family affairs of the deceased. The deceased was suffering from mental disease and she was undergoing regular treatment for mental ailment. The petitioner is languishing in custody since 24.04.2017. Co-accused namely Nikhat Praveen @ Guddi has been enlarged on bail by a co-ordinate bench of this court vide order dated 09.02.2017 passed in Cr. Misc. No. 2351 of 2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No. 151 of 2016.
