NILU AGRAWAL ORAL ORDER 27-03-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel appearing on behalf of the erstwhile Electricity Board, the Bihar State Power Distribution Company.

Petitioner has prayed for modification of the order dated 15.01.2019 passed in CWJC No. 1021 of 2019 whereby the petitioner was directed to file a representation before the respondent no. 6, the General Manager-cum-Chief Engineer, Transmission Zone, Muzaffarpur for ventilating his claim by way of fresh representation which would be disposed of within

Patna High Court MJC No.657 of 2019(3) dt.27-03-2019 2/2 two months and any amount due would be paid within one month thereafter. He submits that he had prayed for other reliefs which is Leave Encashment, Group Insurance and grant of Super Selection Grade which he submits has not been taken into consideration.

From the pleadings and the order passed on 15.01.2019, the present application for modification of the order dated 15.01.2019 passed in CWJC No. 1021 of 2019 is a misplaced modification application.

However, a liberty is granted to the petitioner to file a fresh representation before the respondent no. 6 regarding all his claims which would be disposed of by the respondent no. 6, the General Manager-cum-Chief Engineer, Transmission Zone, Muzaffarpur within two months of filing of such representation. If any amount left, would be paid within one month thereafter. The modification application being MJC No. 657 of 2019 is disposed of accordingly.
