The petitioner apprehends his arrest in Magadh Medical Police Station Case No. 40 of 2013, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that while his brother Naushad Ahmad Khan was returning from his village, he got information that his brother was killed. The informant suspected that the petitioner and others might have killed his brother on account of enmity.

Learned counsel for the petitioner submits that except suspicion there is no material against the petitioner. Jamshed Mian

Patna High Court Cr.Misc. No.8657 of 2015 (2) dt.04-03-2015 2/2 and Md. Idris Khan have already been granted anticipatory bail by this Court vide order passed in Cr. Misc. No. 32838 of 2013 and Cr. Misc. No. 19040 of 2014 and the case of the petitioner stands on similar footing. The petitioner has got no criminal antecedent. Considering the facts aforesaid and the fact that the informant suspected the hands of the petitioner in killing of his brother, but on similar facts two aforesaid accused persons have already been enlarged on anticipatory bail, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gaya in connection with Magadh Medical Police Station Case No. 40 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.)
