The petitioner seeks bail in connection with Durgawati P.S. Case No. 381 of 2024 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2), 125, 132, 121(1), 121(2) and 324(4) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner along with 40-50 unknown persons are alleged to have damaged the police jeep holding pistol, lathi, danda and hockey stick in their hands and he also assaulted the informant and excise personnel and dettered the informant and excise personnel from performing their duties.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. Local persons disclosed the name of the accused persons including the petitioner. There is general and omnibus allegation against the petitioner. The petitioner is in custody since 07.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Mohania, Kaimur/ concerned Court in connection with Durgawati P.S.
