Mr. Suresh Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-09-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings.

The petitioners apprehend their arrest in a case registered for the offences punishable under Section 387 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 16.10.2021 at 9:00 PM, when he was roaming on the road when both the petitioners intercepted him and said that land bearing Khata No. 27 belongs to them to which the informant protested, thereafter

No.13356 of 2022(2) dt.16-09-2022 2/3 it is alleged that the petitioners demanded extortion of Rs. 4 lakh and threatened that if the extortion is not paid they will not allow him to plough the field and will kill him. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that from bare perusal of allegation as alleged in the FIR, it would manifest that the same does not inspire confidence, it is next submitted that admittedly on account of land dispute a false case came to be instituted against the petitioners, as no prudent man who contends that the land belongs to him would seek extortion in lieu thereof. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection
