JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code and Section 4/8 of POCSO Act. As per the prosecution case, this petitioner along with other accused persons is alleged to have kidnapped the daughter of the informant with intention to sell or kill her. Learned counsel for the petitioner submits that victim in her statement under Section 164 stated that she was in love with co-accused Vikram Kumar and she had fled away with him on her own sweet will and that nobody had kidnapped her. She solemnized the marriage with him in Jalandhar. The medical board assessed the age of the victim to be 19 years. Petitioner has got clean antecedent.

No.13861 of 2023(3) dt.23-06-2023 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-7 cum Special Judge, POCSO Act, East Champaran at Motihari in connection with Madhuban P.S. Case No.11 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
