The petitioner seeks regular bail in connection with Ghorasahan (Jitna) P.S. Case No. 76 of 2017 dated 1.3.2017, registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation against the petitioner is with regard to him carrying nepali liquor and in the process being apprehended by the police.
Learned counsel for the petitioner submits that the petitioner has clean antecedent, nothing has been recovered from the possession of the petitioner and he is in jail custody since
Patna High Court Cr.Misc. No.29204 of 2017 (2) dt.01-07-2017 2/2 1.3.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikarhana in connection with Ghorasahan (Jitna) P.S. Case No. 76 of 2017.
