18-06-2020 Heard learned counsel for the parties through video conferencing.

The petitioners seek bail in Saharghat P.S. Case No. 60 of 2017, corresponding to G.R. No. 550 of 2017, registered for the offence under Sections 143, 447, 114, 115, 353, 504, 506 of the Indian Penal Code.

The prosecution case is that due to death of Bhune Yadav due to electric short, U.D. Case No. 03 of 2017 was registered and after the post-mortem examination of deceased, the family members and other villagers put the dead-body on NH-75 and blocked the road and started demanding

Patna High Court CR. MISC. No.11147 of 2020(2) dt.18-06-2020 2/2 compensation. It is further alleged that they also abused police personnel and threatened to damage the vehicles. It is submitted on behalf of petitioners that there is general & omnibus allegation and no specific overt act against the petitioners. The petitioners have no criminal antecedent. It is further submitted that two similarly situated co-accused have already been granted anticipatory bail by this Court, vide order dated 03-09-2019 in Cr.Misc. No. 55837 of 2019 and order dated 20-09-2019 in Cr.Misc. No. 59591 of 2019 (Annexure 2 series).

Considering the aforesaid facts and circumstances, in the event of arrest or surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Benipatti, District - Madhubani in connection with Saharghat P.S. Case No. 60 of 2017, corresponding to G.R. No. 550 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
