2. The petitioner has preferred this application for grant of regular bail in connection with Durgawati P.S. Case No. 380/2024 dated 07.12.2024 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2), 117(2), 125, 109, 132, 121(1), 121(2) and 324(4) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with 40-50 unknown persons holding pistol, lathi, danda and hockey stick in their hands are alleged to have damaged the police jeep and they also assaulted the informant and police personnel causing injury. It is further alleged that the accused persons caused hindrance in discharge the official duty of the police personnel.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession

Local persons disclosed the name of the accused persons including the petitioner. There is general and omnibus allegation against the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 05.03.2025 passed in Cr. Misc. No. 11497 of 2025. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 10.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Mohania, Kaimur, Bhabua in connection with Durgawati P.S. Case No. 380/2024.

7. The application stands allowed.
