The petitioners being the maternal brothers and maternal aunt of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after five years of marriage for non-fulfillment of motorcycle and rupees forty five thousand. It is alleged by the informant that her brother-in-law (Dewar) reached to the in-laws house of the daughter of the informant on 31.05.2015 and saw

Patna High Court Cr.Misc. No.9551 of 2016 (2) dt.01-03-2016 2/2 the dead body of her daughter lying in the courtyard, thereafter the accused persons confined the brother-in-law of the informant in a room and got the dead body disappeared.

It is submitted by learned counsel for the petitioners that the petitioners are not the family members of the husband of the victim rather they are relatives and even assuming the accusation only offence under Section 201 IPC is made out against the petitioners, which is bailable. Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 235 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
