Petitioner is languishing in custody since 20.02.2017 in connection with Karja P.S. Case No. 24/17 for offences punishable under Sections 25(1-b) a/26/35 of the Arms Act. The prosecution case, as lodged by the police personnel, is that on patrolling duty they received a secret information that two criminals are planning to commit some crime and the police apprehended two persons including the petitioner. From the possession of the petitioner one country-made pistol was recovered, and, accordingly, a seizure-list was prepared. It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.27850 of 2017 (4) dt.07-08-2017 2/2 petitioner that he is innocent, bears no criminal history and no overt act has been committed by him. He submits that chargesheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Karja P.S. Case No. 24/17.
