The petitioner apprehends his arrest in a case under Sections 323, 307, 379, 504, 506/34 of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The petitioner filed complaint case and that is why he has falsely been implicated in the case. There is no specific allegation of assault against the petitioner but it appears from perusal of the case diary that witnesses including Atwaria, who is an injured witness, named the petitioner that petitioner was also one of the assailants of the victim, Kalam Kumari, and subsequently Kalam Kumari died during the course of treatment.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.9500 of 2016 (4) dt.20-06-2016 2/2 allegations made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
