13-07-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.
Petitioner Shankar Prasad who happens to be an employee of M/s Medi World Pharmaceutical was carrying expired medicine for destruction, was intercepted by the informant who inspected the medicines and then thereafter, the establishment was searched, proprietors were interrogated. Though, nothing abnormality was seen however instant case has been instituted on account of illusion having at the end of the informant that throwing of expired medicine may be misused by any human being which could be proved disastrous. Admittedly, petitioner Raju Kumar @ Raj Kumar was apprehended while he was discharging his function at the establishment. Both the petitioners are under custody since 03.05.2017 having no criminal antecedent.
Patna High Court Cr.Misc. No.32052 of 2017 (2) dt.13-07-2017 Accordingly, petitioners Shankar Prasad as well as Raju Kumar @ Raj Kumar each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Patna City in connection with Agamkuan P.S. Case No.193/2017.
