JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.1.2017, seeks bail in Bidupur PS Case No. 220 of 2016 (Sessions Trial No. 224 of 2017) registered under Section 394 of the IPC.

The allegation in brief is that some unknown motorcycle borne miscreants looted money from the Noselman of the Petrol Pump.

Learned Counsel for the petitioner submits that neither any material has been recovered from his possession nor he was put on TIP, there is no material except disclosure of his name in the confessional statement by a co-accused Ranjeet Kumr, petitioner is in custody since 9.1.2017, moreover similarly situated co-accused Prince Kumar and others have been admitted to bail by a coordinate Bench of this Court vide Cr. Misc, No. 11708 of 2018. Having considered the said facts and circumstances, the petitioner, namely, Ajay Rai @ Ajay Kumar Roy is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, VIII, Vaishali at Hajipur in connection with Bidupur PS Case No. 220 of 2016 (Sessions Trial No. 224 of 2017).
