This is a petition for grant of regular bail for offence under Section 302/34 of the Indian Penal Code. The victim daughter of the informant was married with the son of this petitioner seven years back. She was mother of two children. Thereafter, the husband married with another lady. Allegation, against all the family members, including the petitioner, is of demand of dowry and torture for the same. Submission of the learned counsel for the petitioner is that presumption of dowry death is not there as death allegedly occurred after seven years of marriage and there is no direct evidence of commission of murder.

Finding substance in the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Sessions Trial No. 55 of 2017 arising out of Sitamarhi P.S. Case No. 463 of 2015 to the satisfaction of the Fast Track Court, II, Sitamarhi, or successor Court.
