Petitioner seeks bail in connection with Town P.S. Case No. 244 of 2017 registered under Section- 290 of the of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that for the alleged recovery of 70 liters of toddy petitioner is in custody since 23.04.2017. Petitioner has no criminal antecedent. Seizure list was not prepared at the time and place of occurrence mentioned therein.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on

Patna High Court Cr.Misc. No.28293 of 2017 (2) dt.28-06-2017 bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge-cum-special Judge, Excise Act, Muzaffarpur in connection with Town P.S. Case No. 244 of 2017.
