ANJANA MISHRA ORAL ORDER 06-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 04.10.2017 in connection with Udwantnagar P.S. Case No. 302/17 registered for the offences punishable under Sections 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that actually there was some altercation between him and police personnel and, therefore, the present case has been lodged against him and it is further submitted that the petitioner is a student of Polytechnic Institute at Ranchi and that he has been falsely implicated in this case and there is no recovery from his conscious physical possession.

Having heard learned counsel for the petitioner and

No.8822 of 2018 (3) dt.06-03-2018 2/2 learned counsel appearing on behalf of the State and since the petitioner has already been in custody for the past five months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, in connection with Udwantnagar P.S. Case No. 302/17.
